Abstract

Crimes are no longer limited by location in the era of the digital revolution; rather, they have developed into a shadow existence that eludes boundaries and wires. This study clarifies the crimes of the modern day, called cybercrimes, which are typified by a level of criminal intellect that has never been seen before and that traditional laws are unable to combat. In order to solve these issues, this study looks at how the true Islamic perspective can be applied, highlighting how Islamic law, with its adaptability and capacity for inference, can take these developments into account. By following guidelines like "closing the gaps" and "preventing corruption," Islamic jurisprudence can provide workable answers to unsolvable issues. The study offers a thorough comparison of the foreign systems that have only recently started to adopt the holistic Islamic approach, which combines treatment through deterrent sanctions with prevention through education and awareness. It also explores the methods of legal proof, which include everything that shows the truth, from technological know-how to circumstantial evidence. In summary, this intellectual journey demonstrates that Islam is not just a religion of the past but also a holistic way of life that looks to the future and offers answers to issues that the early generations could not have even envisioned but that are consistent with the universal rules that the Muslim mind has created.
